LUXXFOLIO Privacy Policy

This Privacy Policy (the “Privacy Policy“) applies to:

  • all websites accessible at the luxxfolio.com domain and provided by LUXXFOLIO Network Inc. (the “Company”);
  • all software and services provided by the Company; and
  • any distributions provided by the Company, including email newsletters;

1.0      Collected Information

1.1      Indelible User Information: To provide and operate features of the Service, we collect and store Indelible User Information. Indelible User Information includes your name, email address, and asset information. Asset information includes: property that you or another user owns, property that you or another user manufactures, unique identifiers for your or another user’s property (including but not limited to SMARTLUXXTM identifiers), the value of your or another user’s property, and other information relating to your or another user’s property.

 

1.2      Mutable User Information: To provide and operate the Service, we collect and store Mutable User Information. When you create an account to access the Service, you provide Mutable User Information such as your: password, contact information, and mailing/billing address. Furthermore, we may acquire information from other companies and third parties to verify your Indelible or Mutable User Information, or if you sync a third party account or service with the Service.

 

1.3      Usage Data: To provide and operate the Service, we collect and store Usage Data, including automatically collecting certain basic information about our users and how they use the Service, such as internet protocol (IP) addresses, device types, browser types, internet service providers (ISP), referring/exit pages, click patterns, etc.

 

1.4      Cookies: The Service may use cookies and similar tools for operation of the Service and to collect Usage Data.

 

2.0      Use of Information

2.1      Indelible and Mutable User Information: We use Indelible and Mutable User Information for the operation of the Service. As part of the Service, we may use Indelible and Mutable User Information to contact you and to send you information regarding the Service. We may also use Indelible and Mutable User Information to advertise and market features of the Service to you, including features provided by our associates. You may unsubscribe from messages forwarded from the Service by following the instructions within the Service. We may anonymize and aggregate Indelible and Mutable User Information and provide the anonymized and aggregated data to third parties, including to third party advertisers, but only if no user can be individually identified in the anonymized and aggregated data.

If you are located outside Canada and choose to provide information to us, please note that we transfer the Collected Information, including your Indelible and Mutable User Information, to Canada and process it there. 3.2      The Company will take all steps reasonably necessary to ensure that the Collected Information is treated securely and in accordance with this Privacy Policy and no transfer of your Indelible or Mutable User Information will take place to an organization or a country unless there are adequate controls in place including the security of your User Indelible and Mutable Information.

 

4.0      Disclosure of Information

4.1      Other Users: Your name and email address may be made available to other users of the Service, for example in search results for a search of users of the Service. Your Indelible and Mutable User Information may be made available to other users of the Service, but the Service will notify you before making such information available to others. For example, to transfer property to another user or to have your property authenticated by another user, the Service will make details of your property available to that other user.

 

4.2      Service Providers: We may engage service providers to perform functions and provide services to us in Canada and abroad. We may share Collected Information with such service providers subject to confidentiality obligations consistent with this Privacy Policy, and on the condition that the service providers use the Collected Information only on our behalf and pursuant to our instructions.

 

4.3      Required Disclosures: Notwithstanding anything to the contrary in this Policy, we may preserve or disclose Collected Information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect the Company’s rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your Indelible or Mutable User Information.

 

4.4      Business Transfers and Affiliates: In the event that the Service or the Company is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, the Collected Information may be sold or transferred as part of that transaction. This Privacy Policy will apply to the Collected Information as transferred to the new entity. We may also disclose Collected Information to our corporate affiliates in order to help provide, understand, and improve the Service and our affiliates’ services, including for marketing and the delivery of advertisements.

 

5.1      Modifying your Mutable User Information

Registered users are provided with tools and account settings to access and modify their Mutable User Information. Registered users can also permanently delete their Mutable User Information. The Company may retain Mutable User Information in accordance with section 4.4, or if the Mutable User Information is part of a larger set of anonymized and aggregated user data, but only if the deleted Mutable User Information is not recoverable from the anonymized and aggregated data.

 

5.2      Accessing your Indelible User Information

Registered users are provided with tools and account settings to access their Indelible User Information. Indelible User Information cannot be modified.

 

6.0      Security of Data

The security of your data is important to us, however, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Indelible and Mutable User Information, we cannot guarantee its absolute security.

 

7.0      Links to Other Sites

The Service may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

 

8.0      Children’s Privacy

The Service does not address anyone under the age of 16 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 16. If you are a parent or guardian and you are aware that your Child has provided us with Indelible or Mutable User Information, please contact us. If we become aware that we have collected Indelible or Mutable User Information from Children without verification of parental consent, we will take steps to remove that information from our servers.

 

9.0      Changes to this Policy

We may revise this Privacy Policy from time to time. The most current version of this Privacy Policy will govern our use of your information and is always available at www.luxxfolio.com. By continuing to access or use the Service after those changes become effective, you agree to be bound by the revised Privacy Policy.
